By using our website or engaging us to perform work, you agree to these terms. If you do not agree, please do not use our website or services.

By accessing our website, submitting a contact or estimate request, or entering into a written agreement with Waltham Fence & Deck for services, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions and our Privacy Policy. These terms may be updated from time to time. The current version will always be available on this page with an updated effective date.
Waltham Fence & Deck provides residential deck building, fence installation, outdoor structure construction, and related repair and finishing services to homeowners and property owners in Waltham, MA and surrounding communities. Services are described on our website for informational purposes. The specific scope of any project is defined in the written estimate and contract provided to each customer before work begins.
We reserve the right to decline any project request at our discretion, including projects outside our service area or outside our area of expertise.
All pricing is provided in written estimates issued before any work begins. An estimate is not a binding contract until both parties have signed a written agreement. Estimates are based on conditions observed at the time of the site visit and the scope discussed. If site conditions or scope change after an estimate is issued, pricing may be adjusted and any changes will be discussed with you in writing before additional work proceeds.
Estimates are valid for 30 days from the date of issue unless otherwise stated. Material prices are subject to change, and we will notify you if a significant change in material costs affects your project before work begins.
Project start dates are scheduled at the time a contract is signed and a deposit is received. Start dates are estimates and may be affected by weather, permit timelines, material availability, or other circumstances outside our control. We will communicate any scheduling changes to you as early as possible.
If you need to cancel or reschedule a project, please notify us in writing as soon as possible. Cancellation terms - including any deposit implications - are outlined in your individual project contract. In general, deposits cover preparatory work, permitting costs, and material orders already placed, and may not be fully refundable depending on the stage of the project.
Payment terms are specified in your written project contract. In general, a deposit is required to secure your project start date, with the remaining balance due upon project completion and final walkthrough. We accept payment by check, bank transfer, or other methods specified in the contract.
Invoices not paid within the timeframe specified in the contract may be subject to a late fee as described in that contract. We reserve the right to suspend work on a project if a scheduled payment is not received.
For projects requiring a building permit, Waltham Fence & Deck will file for and manage the permit process with the applicable local building department. Work will not begin until the required permits are issued. The customer is responsible for ensuring that any applicable homeowner association or neighborhood design review approvals are obtained before construction begins. We are not responsible for delays resulting from HOA review processes or approvals outside of city permitting.
Waltham Fence & Deck stands behind the quality of our work. Any specific workmanship warranty is outlined in your individual project contract. Materials are covered by the warranties provided by their respective manufacturers, and we will assist you in submitting a manufacturer warranty claim if applicable.
Beyond any express warranty stated in your contract, our services are provided "as is" without additional warranties, express or implied. We do not warrant that our services will meet every expectation beyond what is expressly described in the project contract.
To the fullest extent permitted by applicable law, Waltham Fence & Deck shall not be liable for any indirect, incidental, consequential, or punitive damages arising from or related to our services or your use of our website, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of a specific project shall not exceed the total contract price paid for that project.
Nothing in these terms limits liability for damages caused by our gross negligence or willful misconduct.
You may use our website for lawful purposes only. You agree not to use our website in any way that could damage, disable, or impair it, or interfere with other users. The content on our website - including text, images, and logos - belongs to Waltham Fence & Deck and may not be reproduced or used without our written permission.
If a dispute arises between you and Waltham Fence & Deck, we ask that you first contact us directly to try to resolve it. Most issues can be addressed through direct communication. You can reach us at projects@walthamfenceanddeck.com.
If we cannot resolve a dispute informally, both parties agree to first attempt mediation before pursuing litigation. Any unresolved claims shall be handled in a court of competent jurisdiction in accordance with the governing law below.
These Terms and Conditions are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles. Any legal proceedings arising under these terms shall be brought in the appropriate courts of Massachusetts.
We reserve the right to update these Terms and Conditions at any time. Changes take effect when posted to this page with an updated effective date. Your continued use of our website or services after changes are posted constitutes your acceptance of the updated terms. We encourage you to review this page periodically.
